EXAMINING THE APPROPRIATENESS OF TECHNOLOGY USE IN INVESTIGATIONS IN RELATION TO THE PRINCIPLES OF INDONESIAN CRIMINAL

Indonesia, as a Pancasila legal state, faces challenges in the criminal investigation process, particularly regarding the inconsistency between the Criminal Procedure Code (KUHAP) and internal police regulations, which affect legal certainty and justice. This research examines the reconstruction of criminal investigations within the Pancasila legal state system to realise justice. The primary issue identified is the misalignment between the KUHAP and internal police regulations, specifically Police Regulation Number 6 of 2019, concerning the use of technology in the investigation process.
The research employs a normative legal method with a legislative and conceptual approach, analysing data qualitatively through literature study and documentation. The findings of the study conclude that the use of technology in the investigation process has the potential to support more efficient law enforcement. However, this technological utilisation must always align with existing legal principles, particularly concerning privacy rights and the right to information, thereby enhancing the professionalism of investigators. The novelty of this research lies in the application of technology in the investigation process without infringing on privacy rights, thereby integrating the principles of the rule of law with the values of Pancasila, especially in the implementation of restorative justice and a humanistic approach. The discussion reveals the importance of technological use in the investigation process, as well as the strengthening of institutional coordination. There is a need for the renewal of legal norms in the investigation process that is not only procedurally effective but also capable of providing substantive justice in accordance with Pancasila values, through the harmonisation of regulations and the strengthening of law enforcement institutions.
